These terms set out the legal notice, the Terms of Use and the Terms of Sale for the Kaught mobile application, published by Jeremy Lasne. The processing of personal data is described separately in our Privacy Policy.

Legal Notice

Mandatory in France under Article 6-III of the LCEN. Included here because the Terms of Use and Terms of Sale refer to it.

Part 1

Terms of Use

1.Purpose

These Terms of Use (“Terms”) define the conditions for accessing and using the Kaught mobile application (the “Application”) and associated services (the “Service”), published by Jeremy Lasne (the “Publisher”, “we”). Any use of the Application implies the user’s (the “User”, “you”) full and unreserved acceptance of these Terms.

2.Definitions

  • Application / Kaught: the mobile application for identifying animals and collecting species, available on iOS and Android.
  • Account: the personal space created by the User to access the Service.
  • Capture: the act of photographing an animal for identification, and the resulting entry added to the Collection.
  • Collection: the set of species “caught” (identified and saved) by the User.
  • User Content: any content submitted by the User, in particular photographs and geolocation data associated with a Capture.
  • Species catalogue: the reference species database provided by the Publisher (see §9).

3.Acceptance and modification of the Terms

Use of the Application constitutes acceptance of the Terms in force. The Publisher may modify the Terms at any time; Users are informed of substantial changes by any appropriate means (in-app notification, email or display at launch). Continued use after the effective date constitutes acceptance of the modified Terms.

4.Access to the Service, registration and Account

4.1. The Application can be downloaded from the App Store (Apple) and Google Play (Google). Access requires a compatible device, an internet connection and, for some features, the creation of an Account.

4.2. The User undertakes to provide accurate information when registering and to keep it up to date.

4.3. The User is responsible for keeping their credentials confidential and for any activity carried out from their Account. Any suspicious use must be reported to hello@kaught.app.

4.4. Minimum age: the Application is intended for people at least 15 years old (the age of digital consent in France). Minors under 15 may only use the Service with the authorisation of the holder of parental authority.

5.Description of the Service

5.1. Kaught lets you photograph an animal, obtain an AI-assisted identification, then add the identified species to a personal Collection, and view your Captures on a map. Your Capture photographs are stored on your device and remain private to your account; the imagery shown on the map and in species entries comes from Kaught’s own catalogue (see §9), not from other users’ photos.

5.2. Identification relies on image-recognition models and a species catalogue. It is provided for information purposes only and is not guaranteed to be accurate (see §11).

5.3. The Service may include free features and paid features (“Kaught Premium” or equivalent), governed by the Terms of Sale.

6.Rules of use

The User undertakes to use the Service in accordance with applicable laws and regulations and, in particular, refrains from:

  • photographing or disturbing animals in breach of applicable regulations (protected species, wildlife tranquillity, private property, parks and reserves);
  • dangerously approaching wild animals or endangering their own safety or that of others to make a Capture;
  • submitting unlawful or misleading content, or content that infringes the rights of third parties;
  • attempting to circumvent, degrade or misuse the Service (reverse engineering, mass data extraction, security breaches, unauthorised automated use);
  • using the Service for poaching, taking or trading species, or any activity harmful to biodiversity.

7.User Content (photographs)

7.1. Ownership: you retain ownership of and the rights to the photographs you take.

7.2. Licence granted to the Publisher: you grant the Publisher a non-exclusive, worldwide, royalty-free licence to store and process your photographs solely to the extent necessary to operate the Service (identification via our AI provider and display within your own Collection). Your photographs are stored on your device; this licence ends when the content or the Account is deleted (see the Privacy Policy).

7.3. Broader reuse: the Publisher does not use your photographs for other purposes (e.g. model improvement, publication, community sharing) without your separate prior consent.

7.4. Responsibility: you warrant that you hold the rights to the content you submit and that it does not infringe the rights of third parties or the law.

8.Publisher’s intellectual property

The Application, its code, design, trademarks, logos (including the Kaught trademark and its visual identity), texts, and the arrangement of the species catalogue are protected and remain the property of the Publisher or its licensors. No licence is granted to the User other than the right to use the Application in accordance with these Terms.

9.Species data and third-party sources

The species catalogue draws on open and freely reusable sources, in particular GBIF, iNaturalist, Wikidata/Wikipedia and Wikimedia Commons. Content from these sources is used in accordance with their licences (CC0 / CC-BY); author credits and licences are shown in the species entry where required. Rarity indications reflect an observation frequency and do not constitute a conservation status or an official scientific opinion.

10.Availability, updates and maintenance

The Publisher endeavours to ensure the availability of the Service but cannot guarantee uninterrupted, error-free operation. The Service may be suspended, modified or interrupted for maintenance, upgrades or technical reasons. The Publisher may change features (add, modify, remove).

11.Limitation of liability — safety warning

11.1. The identification provided by Kaught is indicative and fallible. It may be wrong, incomplete or imprecise.

11.2. NEVER RELY on Kaught for any safety, health, dietary or medical decision. In particular, the Application must not be used to determine whether an animal (or any other organism) is dangerous, venomous, toxic, edible or fit for consumption, nor to assess a risk of bite, sting, allergy or poisoning. If in doubt, or in the event of contact, a bite/sting or ingestion, contact the emergency services or a poison control centre.

11.3. The User remains solely responsible for their safety and behaviour towards wildlife and the environment.

11.4. To the extent permitted by law, the Publisher is not liable for indirect damages, nor for damages resulting from misuse of the Service or reliance on an identification. Nothing in these Terms limits liability in the event of gross negligence, wilful misconduct, or harm to life or physical integrity, in accordance with applicable law.

12.Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

13.Term, termination and suspension

13.1. The Terms apply for the entire duration of use of the Service.

13.2. You may stop using the Service and delete your Account at any time from the Application or by writing to hello@kaught.app.

13.3. The Publisher may suspend or terminate access in the event of a breach of these Terms, after notice where possible.

14.Governing law and dispute resolution

14.1. The Terms are governed by French law.

14.2. In the event of a dispute that cannot be resolved directly, you may, as a consumer, refer the matter free of charge to a consumer mediator. Before any referral, please contact us first at hello@kaught.app so that we can seek an amicable solution and provide the details of the competent mediator. You may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

14.3. Failing amicable resolution, the competent courts are determined in accordance with statutory rules (for consumers, the protective rules of their jurisdiction apply).


Part 2

Terms of Sale

1.Purpose and scope

These Terms of Sale (“Sales Terms”) govern the sale of the Application’s paid features and subscriptions (collectively, “Kaught Premium”). They apply to any purchase made via the Application. Making a purchase constitutes acceptance of the Sales Terms.

2.Offers and paid features

2.1. Kaught Premium unlocks full access to the Application — including the leaderboard and unlimited photo captures — whereas the free version provides limited access.

2.2. Kaught Premium is offered as a weekly, monthly or yearly subscription. The details (content, duration, price) are shown in the Application before purchase.

3.Prices

3.1. Prices are shown inclusive of all taxes, in the currency displayed by the app store, and may vary by country and according to the platforms’ pricing policy.

3.2. Indicative prices: $1.10 / week, $7.99 / month or $39.99 / year (shown in your store’s local currency, and subject to the platform’s regional pricing). The applicable price is the one displayed at the time of purchase.

4.Payment terms — purchases via App Store / Google Play

4.1. Purchases and subscriptions are processed by Apple (App Store) or Google (Google Play) depending on your platform. Payment is collected by the platform, which acts as payment and billing intermediary.

4.2. The transaction is governed, for its payment part, by the platform’s terms (Apple Media Services / Google Play Terms of Service) and by the User’s account (Apple ID / Google account).

4.3. The Publisher does not receive or store your bank card details.

5.Term, renewal and cancellation of subscriptions

5.1. Subscriptions renew automatically for the subscribed period unless renewal is turned off.

5.2. Managing and cancelling a subscription (turning off automatic renewal) is done in your App Store or Google Play account settings, and not directly with the Publisher. Cancellation takes effect at the end of the current period; Premium access remains active until then.

5.3. Renewal is billed within the 24 hours before the end of the current period, at the current rate.

6.Free trial (if applicable)

If a free trial period is offered, it automatically converts into a paid subscription at its end, unless renewal is turned off before the end of the trial. Any unused portion of a trial is forfeited if a subscription is taken out early.

7.Right of withdrawal

7.1. In accordance with Article L221-28 8° of the French Consumer Code, for the supply of digital content not provided on a tangible medium whose performance begins immediately after purchase, the consumer expressly waives their 14-day right of withdrawal by confirming the purchase and accessing the Premium content.

7.2. Notwithstanding the above, refund requests are subject to Apple’s and Google’s policies (see §8).

8.Refunds

As purchases are processed by the platforms, refund requests must be addressed to Apple or Google depending on the store of purchase (“Report a Problem” / “Request a refund” procedure). The Publisher may, on a goodwill basis and without obligation, provide assistance at hello@kaught.app.

9.Changes to prices and offers

The Publisher may change prices and offers. Any price change to an ongoing subscription is notified and, where regulations or the platform require, subject to your consent; failing which, the subscription is not renewed at the new rate.

10.Customer service and complaints

For any question about a purchase: hello@kaught.app. The consumer mediation mentioned in Part 1, §14.2 is also available for disputes relating to the Sales Terms.

11.Governing law

The Sales Terms are governed by French law, without prejudice to the protective public-order provisions applicable to consumers.
